PURE FITNESS 2.0 1903 E Sabine, Victoria, TX 77901 GYM WAIVER & RELEASE OF LIABILITY Participant Name: N/A Address: N/A This Waiver and Release of Liability (“Agreement”) is entered into between Pure Fitness 2.0, located at 1903 E Sabine Victoria, TX 77901, and the undersigned participant (“Participant”). 1. Assumption of Risk I understand that participation in fitness activities, exercise classes, personal training, weightlifting, use of gym equipment, cardio machines, group activities, or any other programs offered by Pure Fitness 2.0 (collectively, the “Activities”) involves inherent and known risks, including but not limited to: Injuries from free weights, resistance machines, or cardio equipment Falls, slips, or contact with other participants Strain, sprain, or overexertion Equipment malfunction or misuse My own health conditions or lack of physical conditioning I certify that I am voluntarily participating in the Activities at my own risk, and I fully accept and assume all risks, both known and unknown, associated with participation. 2. Release of Liability To the fullest extent permitted by law, I hereby release, waive, and discharge Pure Fitness 2.0, its owners, managers, members, employees, trainers, contractors, volunteers, agents, representatives, successors, and assigns (“Releasees”) from any and all claims, demands, or causes of action arising out of or related to: The negligence of the Releasees, including ordinary negligence My participation in any Activities My use of the facilities, equipment, or services Any injury, illness, damage, loss, or death I may suffer I understand and agree that this release applies even if the injury or damage is caused by the Releasees' OWN NEGLIGENCE. This release does not apply where prohibited by state law. 3. Indemnification I agree to indemnify, defend, and hold harmless the Releasees from any claims brought by me or on my behalf, or by any third party as a result of my actions, participation, or conduct while using the facilities or participating in Activities, including attorney’s fees and costs. 4. Medical Authorization If I require emergency medical care while at Pure Fitness 2.0, I authorize the Releasees to: Provide first aid, CPR, or AED assistance Contact emergency medical services Share necessary medical information with responders I agree that I am responsible for all resulting medical expenses and that I should maintain my own health insurance. 5. Physical Condition I certify that: I am medically and physically able to participate in fitness activities. I have no health conditions that would prevent safe participation. I will not use equipment or participate if injured, ill, or otherwise impaired. I agree to follow all gym rules, posted guidelines, and instructions from gym staff. 6. Damage to Facilities or Equipment I agree to be responsible for any damage to gym equipment, facilities, or property caused by my willful misconduct, negligence, or misuse. 7. Governing Law This Agreement shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law principles. 8. Severability If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force. Any invalid term shall be modified only to the extent necessary to render it valid and enforceable. 9. Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior verbal or written agreements.
